These terms govern your use of this website. Use of the Sommet360 application is governed separately by the subscription agreement signed with your organisation.

Scope

These Terms of Use ("Terms") apply to this public website (the "Website"), operated by Sommet Global ("Sommet Global", "we", "us"), a company incorporated in Switzerland with its registered office at Route de l'Aéroport 10, 1950 Sion, Switzerland.

These Terms do not govern access to or use of the Sommet360 application. Application access is granted only under a separate written subscription or master services agreement with the licensing organisation, and that agreement prevails for all matters relating to the application.

Acceptance

By accessing or browsing the Website you confirm that you accept these Terms. If you do not accept them, please do not use the Website. Where you use the Website on behalf of an organisation, you confirm that you have authority to accept these Terms for that organisation.

Website Content and Product Information

The Website is provided for general information and marketing purposes. Descriptions of Sommet360 capabilities, screenshots, videos, pricing indications and roadmap statements are illustrative, may be simplified for presentation, and may change without notice. They do not form an offer, a warranty, or a contractual commitment as to specific functionality or results.

Nothing on the Website constitutes legal, tax, accounting or employment advice. Any binding commitment about product scope, pricing or service levels is made only in a signed agreement.

Enquiries, Demo and Quote Requests

When you submit a contact, demo or quote form, you agree to provide accurate information and not to submit content that is unlawful, misleading, or that you are not authorised to share. Submitting a form starts a commercial conversation only; it does not create a contract or a right of access to the application. Personal data submitted through these forms is handled as described in our Website Privacy Policy.

Intellectual Property

All content on this Website — including text, page designs, layouts, graphics, logos, trademarks, screenshots, videos and source code — is owned by Sommet Global or its licensors and is protected by intellectual property law. "Sommet360" and "Sommet Global" and associated logos are our trademarks.

You may view and print pages for your own internal, non-commercial evaluation. You may not copy, republish, redistribute, frame, mirror, scrape, mine or create derivative works from Website content, or use our trademarks, without our prior written consent. Ownership of the Sommet360 software itself remains with Sommet Global in all cases.

Acceptable Use of the Website

You agree not to:

  • use the Website unlawfully or in breach of third-party rights;
  • attempt to gain unauthorised access to the Website, its hosting environment or any connected system;
  • introduce malicious code or interfere with the integrity, availability or performance of the Website;
  • conduct penetration testing, vulnerability scanning, load testing or benchmarking without our prior written consent;
  • use automated scraping, crawling or harvesting tools other than well-behaved search engine crawlers acting within our robots directives;
  • submit spam, bulk or fraudulent form submissions, or impersonate another person.

Availability

The Website is provided on an "as is" and "as available" basis, without service level commitments. We may change, suspend or withdraw pages, content or the Website as a whole at any time, and we may perform maintenance without prior notice.

Third-Party Links and Services

The Website links to third-party sites and uses third-party services such as hosting, form handling, email delivery and analytics. Those sites and services are governed by their own terms and privacy notices, and we are not responsible for their content, availability or processing practices. A link does not imply endorsement.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of profits or loss of business arising from your use of, or inability to use, the Website, or from reliance on Website content. Our aggregate liability in connection with the Website is limited to CHF 1,000.

Nothing in these Terms excludes liability for wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot be limited under Swiss law.

Governing Law

These Terms are governed by the substantive laws of Switzerland, excluding its conflict of law rules. The ordinary courts of Sion, Canton of Valais, Switzerland have exclusive jurisdiction, subject to any mandatory jurisdiction that applies to consumers.

We design this Website to be usable by as many people as possible and work towards alignment with WCAG 2.1 level AA, including keyboard navigation, sufficient colour contrast, focus visibility and descriptive labels. If you encounter an accessibility barrier on the Website, contact accessibility@sommetglobal.com and we will assess the issue and propose a remedy or an accessible alternative.
